AN ORDINANCE AMENDING SEC. 3 PARAGRAPH (D) OF CITY ORD. NO. 1447 ENTITLED: AN ORDINANCE REGULATING THE OPERATION OF COCKPITS IN THE CITY OF CEBU

This ordinance regulates the holding of cockfights and derbies in Cebu City on regular days aside from Sundays and legal holidays.  Provided, it shall be allowed only in licensed cockpits.  It stipulates that on weekdays, it shall not go beyond ten o’ clock in the evening.

AN ORDINANCE AMENDING SEC. 3, ART. III OF ORD. NO. 801, OTHERWISE KNOWN AS THE TRAFFIC CODE OF CEBU CITY, AS AMENDED.

This ordinance amended Sec. 3 of the Cebu City Traffic Code on the designation of authorized tow vehicles.  Such vehicles should be equipped with the required safety devices and tools necessary for towing vehicles, and that the owner thereof has the requisite adequate storage area for towed vehicles.

AN ORDINANCE ESTABLISHING A RESTRUCTURING PROGRAM OF THE PENALTY CHARGE ON SOCIALIZED HOUSING LOANS, PROVIDING MECHANISM THEREFOR AND FOR OTHER PURPOSES

This ordinance adopts the policy of providing a continuing program of housing that is affordable.  It establishes a restructuring program for the penalty charges of socialized housing loans, mainly to prevent the penalty charge from ballooning should the delinquency continue.

AN ORDINANCE PROHIBITING PERSONS CONCEALING THEIR FACES IN ORDER TO AVOID BEING KNOWN AS IDENTIFIED DURING LABOR STRIKES IN BUSINESS ESTABLISHMENTS IN THE CITY OF CEBU, PROVIDING PENALTIES FOR THE VIOLATION THEREOF AND FOR OTHER PURPOSES

This ordinance prohibits the concealing or covering of faces of some participants to avoid being identified during strikes, pickets or protests.  The presence of these “faceless” strikers can lead to suspicion that they are not legitimate strikers but intruders or troublemakers.

AN ORDINANCE AMENDING SECTIONS 4,5,7,9,11,14,16,17,19 & 26 OF CITY ORD. NO. 2111 ENTITLED: AN ORDINANCE PROVIDING FOR VEHICLES EMISSION POLICIES, PROVIDING PENALTIES THEREFORE AND FOR OTHER PURPOSES

This ordinance aims to protect public health and preserve the living environment with respect to air pollution, by controlling emissions of smoke and particulate and by setting maximum permissible limits for automobile exhaust gases.  This ordinance amended the emission standards for both spark-ignition engines (gasoline) and compression-ignition engines (diesel).  These standards will be subject to change per updated DENR administrative orders and policies.

AN ORDINANCE EXPROPRIATING A PORTION OF LOT SITUATED IN BRGY. CALAMBA FOR THE OPENING OF A NEW ROAD FROM V. RAMA TO CORNER KATIPUNAN AND A. LOPEZ ST. OF BRGY. LABANGON

This ordinance authorizes the Acting Mayor of Cebu City to initiate expropriation proceedings and appropriating P2,608,000.00 for payment of just compensation to the owners over a certain portion consisting of 1,304 square meters of parcel of land known as Lot No. 6784-B-3, situated in Brgy. Labangon, Cebu City.  This land will be utilized for public use specifically the opening of a road to connect V. Rama Ave., to the junction of A. Lopez St. and Katipunan Street.

AN ORDINANCE PRESCRIBING ELECTRONIC FEES IN THE APPLICATION FOR BUILDING PERMITS PURSUANT TO THE NEW SCHEDULE OF FEES AND OTHER CHARGES OF THE REVISED IMPLEMENTING RULES AND REGULATIONS  (IRR) OF THE NATIONAL BUILDING CODE OF THE PHILIPPINES (PD 1096).

AN ORDINANCE MODIFYING THE PROVISIONS OF ORDINANCE NO. 1656, AS AMENDED, OTHERWISE KNOWN AS THE "1996 ZONING ORDINANCE OF THE CITY OF CEBU BY DECLARING ALL LANDS ACQUIRED UNDER ACT 1120, OTHERWISE KNOWN AS THE FRIAR LANDS ACT, AS AMENDED, BE DEVOTED FOR THE PURPOSE FOR WHICH THEY WERE ACQUIRED AND FOR OTHER PURPOSES."

This ordinance declares that the development framework in the Northern Development Zone as defined in the Comprehensive Land Use Plan is completed and adequate and that until new networks of access are available, major commercial development in the said area shall not be encouraged so as not to hamper the land use development in other parts of the city particularly the barangays beyond Talamban; and all land acquired under Act No. 1120 as amended by any branch, subdivision or entity shall be devoted solely for its purpose which is for public service and use.

AN ORDINANCE DECLARING THE OLD MABOLO TREE LOCATED ALONG THE CORNER OF C. BORCES AND C. MINA STREETS, BARANGAY MABOLO AS HERITAGE TREE OF CEBU CITY.

This ordinance declares an old Mabolo tree located at the area specified as the Heritage Tree of Cebu City.  This tree was reportedly commonly cultivated for its fruits and as a shade tree in the barangay way back in the 1900’s.  Said tree has the height of around 60 feet.  Senior residents of the barangay attest that said Mabolo tree is not only a living legacy to the historic name of Brgy. Mabolo but is an apt symbol of the city government’s program thrust to protect the environment.

This amendatory ordinance declares Noli Mi Tangere Street from one-way to a two-way street.  As per observation by the CITOM, the volume of vehicular traffic passing through this area is very light as there are PUJs passing thereat.

This amendatory ordinance regulates the pedal-operated “trisikads”.  This ordinance deletes or excludes the provision of “slicing” or detaching its sidecar as a penalty which may present a controversial gray area in its legality.  Likewise, this ordinance specified penalties to be imposed on the owner of the tricycle (trisikad) for any violation.

This ordinance amends Sec. 35, Chapter VIII of the City Tax Ordinance LXIX- the City of Cebu shall levy and collect specified amount per cubic meter on ordinary stones, sand, gravel, earth and other quarry resources as defined under the national Internal Revenue Code

This amendatory ordinance is enacted to address the increase in serious crimes by juveniles, which include murder, rape, theft, drugs, etc.  It has been observed that minors prefer to gather, wander and saunter in streets, alleys and other conspicuous places at the wee hours of the night.

This ordinance is enacted to regulate the joining of minors in fraternities.  It has been observed that the concept of fraternities is now being utilized by some as a tool for protection against foes and vengeance for enemies resulting to gang wars; and more fraternities have been implicated in countless violent-related incidents and a number of these incidents involve minors.

AN ORDINANCE AMENDING SECTION 1, (F) OF CITY ORD. NO. 1791, ENTITLED: "AN ORDINANCE ESTABLISHINGTHE GUIDELINES TO BE FOLLOWED IN THE PROPOSALS, APPLICATIONS, RECOMMENDATIONS OR REQUESTS FOR THE NAMING AND REMAMING OF PUBLIC STREETS, PLAZAS, AND/OR BUILDINGS."

This ordinance is enacted to amend Section 1 (F) of City Ord. 1791 on the guidelines in the proposals, applications requests for the naming or renaming of public streets, plazas, and/or buildings.  The Section specified a five-year reglamentary period from the death of the person whose name is to be honored, and prior to that, any proposal shall not be entertained even if all records are readily available.  This ordinance intends to waive the five-year period upon the recommendation of the Cultural & Historical Affairs Commission (CHAC), duly approved by the Sangguniang Panlungsod of Cebu City.

This ordinance is enacted to address the Cebu South Bus Terminal’s difficulty in accommodating and/or increasing number of buses and mini-buses that have increased throughout the years.  The presence of mini-buses at the South Bus Terminal further contributed to the worsening traffic congestion in the area.  This ordinance is prohibiting the Public Utility Buses to load and unload passengers within the three hundred (300) meter radius from the Terminal.
